ACM’s market analysis decision on unbundled local access to be further substantiated

ACM will further substantiate the market analysis decision on unbundled local access, and will make adjustments to certain parts of the analysis. This has been the outcome of talks between the European Commission and the Netherlands Authority for Consumers and Markets (ACM).  These talks were initiated following the serious doubts that the European Commission expressed in late-April about ACM’s draft market analysis decision. ACM has analyzed the positions of both the European Commission and that of BEREC, the collaboration between European telecom regulators, and has come to the conclusion that its decision needs further substantiation. The revised draft market analysis decision will be reconsulted with market participants, and will subsequently be renotified to the Commission.

“We are very confident that the revised draft market analysis decision will withstand the scrutiny of the European Commission,” says Henk Don, Member of the Board of ACM. Mr. Don continues: “With the draft market analysis decision, ACM guarantees that competitors such as Tele2, Vodafone and Online continue to have access to KPN’s network. This leads to more options and lower prices for consumers and business users when it comes to broadband internet, fixed telephony services, and business network services.”

As long as the new decision has not been finalized yet, the current regulatory regime will remain in place. KPN thus continues to offer access to its competitors. ACM is aiming to issue a final decision by the end of the year.
