Position paper Data Governance Act (DGA)

This year, the European Commission is conducting an evaluation of the Data Governance Act (DGA). With the DGA, the European Commission aims to ensure that data can be shared safely, fairly and reliably. The ACM plays an important role in its implementation as the competent authority in the Netherlands. The ACM has therefore shared its vision and recommendations with the European Commission.

The ACM recognizes the importance of the DGA as an essential instrument for strengthening the European data economy. At the same time, it observes that certain aspects could be improved. In particular, the current definition of data intermediation services may give rise to differences in interpretation. Moreover, certain obligations, if applied too rigidly, could unintentionally hinder organizations. The ACM therefore calls for clarification of the definition and a lighter regime for data intermediaries. Furthermore the ACM advocates for more efficient international cooperation to ensure better harmonization of legislation within the EU.

By actively contributing to making the legislation work better in practice, the ACM aims to create a more effective DGA. This will contribute to a robust, competitive, and fair European data economy.
