Data Governance Act: registration of data intermediation service providers and application for EU label now online
Since 19 November 2024, the Netherlands Authority for Consumers and Markets (ACM) has been charged with enforcement of compliance with the European Data Governance Act (DGA). Businesses and organizations that are active in data intermediation must meet certain requirements, if they wish to continue to offer their services in the EU. One such requirement is the mandatory registration with ACM. In addition, they can apply for an ‘EU label’ of trust mark. Data-altruistic organizations, too, may apply for an EU trust mark. Businesses and organizations can now go to ACM’s website and follow the required steps.
The DGA entered into force in September 2023, and its objective is to have more data become available for general use. The use and sharing of data enable organizations and businesses to innovate, and, as such, can help society and the economy evolve and grow further. When sharing data, everyone must be able to have confidence that the data is monitored, and that the data is processed properly.
Registration requirement
Data intermediation service providers are subject to a registration requirement. These are, for example, platforms or marketplaces where market participants are able to offer their data to others. Another example of data intermediation services are providers of technological products or systems (Product Information Management Systems, or PIMS) that grant users access to data (anonymized or otherwise) of individual users.
Data-altruistic organizations
Data-altruistic organizations may register on a voluntary basis. These are non-profit organizations that share data in the public interest such as health care and science. This involves data that individuals or organizations make available voluntarily, for example organizations that offer a data platform where consumers are able to share data voluntarily regarding their utility consumption (water, natural gas, and electricity), for example for research projects.
EU trust mark
Both data intermediation service providers and data-altruistic organizations can apply for an EU trust mark. An EU trust mark may increase confidence in a data intermediation service provider or data-altruistic organization. EU trust marks are granted if it has been demonstrated that the organization has met all of the statutory requirements laid down in the DGA.
Last year, when the Dutch implementing act of the DGA had not yet come into force, market participants were able to submit pre-notifications to ACM. The implementing has now come into force. Market participants that had submitted pre-notifications have each been informed by ACM that they are now able to file official applications for registration and EU trust marks.
