OPTA’s response to KPN’s press release concerning discounts
The Commission of OPTA, the Independent Post and Telecommunications Authority, has taken note of the press release entitled KPN verricht intern onderzoek naar kortingen [KPN Conducts Internal Investigation into Discounts], which KPN has disseminated today. The Commission wishes to respond to it as follows.
- More than a month after receiving complaints from various market parties (whose names shall not be mentioned), OPTA commenced an investigation. This investigation focused on discounts which KPN provided to its business customers for regulated services, which could be in contravention of the Telecommunications Act. When this investigation started, a number of written questions concerning this matter were presented to KPN.
- Recently KPN made a verbal request to OPTA for a postponement before answering these questions. OPTA consented to a limited postponement.
- Yesterday, 18 October, KPN notified the Commission that the company had ordered an investigation into discounts for regulated services which were not reported to or approved by OPTA in spite of its duty to ensure this was done.
- The Commission took note of this announcement and indicated that it would be proceeding with its own investigation and that the relevant procedures would apply.
In the interests of this investigation OPTA will not be making any further announcements concerning this matter.
OPTA (Independent Post and Telecommunications Authority) has been in existence since 1997 and has been entrusted by the Dutch government with the duty to regulate the postal and telecommunications markets in the Netherlands. In addition, OPTA has a duty to ensure that there is adequate competition in these markets. It has a number of duties and powers for this purpose, which is set out in the relevant legislation. Decisions are taken by OPTA’s independent Commission and are binding on the various market parties.
