Regulatory Policy Note 3: Imposing Access Obligations

The New Regulatory Framework for Electronic Communication requires fot access obligations to be imposed that there is significant market power (SMP) on the upstream market. The requirements for imposing access following general economic reasoning and the principles of the NRF means that access obligations can only be imposed if there is wholesale and (the risk of) retail SMP.
