Guidelines on Cooperation between Undertakings

The revised Guidelines on cooperation between undertakings (April 2008) contain clear and useful examples, illustrating what is allowed and what is not allowed under the Dutch Competition Act. In addition, partly as a result of the considerable amount of questions from market participants on these particular subjects, the chapters on recommendations from trade organizations and on the exchange of information have been rewritten, and relevant examples have been added. Furthermore, the NMa has created a useful tool: a flow chart to help readers find the information they are looking for in the Guidelines. Using this flow chart, undertakings can find out for themselves whether or not their agreements or arrangements with other undertakings are allowed. These Guidelines have been developed in close cooperation with, among other organizations, Royal Association MKB-Nederland (MKB Nederland) and the Confederation of Netherlands Industry and Employers (VNO-NCW).
