NMa releases new Procedure in relation to the Inspection and Copying of Analog and Digital Data and Documents

By publishing the newest version of its Procedure in relation to the Inspection and Copying of Analog and Digital Data and Documents, which has today become available for download from the NMa's website, the Netherlands Competition Authority (NMa) aims to be able to carry out investigations more efficiently, while at the same time properly safeguarding the rights of undertakings and natural persons. With the publication of this new procedure, the previous one ('Procedure in relation to the Inspection and Copying of Digital Data and Documents 2007') has been repealed as of August 17, 2010.

The Procedure in relation to the Inspection and Copying of Analog and Digital Data and Documents gives a general outline of the NMa's actions and procedures during investigations into violations of the Dutch Competition Act and the transport and energy laws. The procedure applies not only to investigations at the premises of undertakings, but also to when demanding information from individuals. 

Earlier this year, the NMa sought input from market participants and fellow investigative agencies on its newest procedure through a written consultation as well as a consultation meeting. On the basis of these reactions, the procedure was adjusted. The reactions the NMa received and the adjustments that were subsequently made can be found on the NMa's website.
