NMa consults over draft guidelines mergers and acquisitions
The Netherlands Competition Authority (NMa) has invited members of the business community and legal profession as well as other organisations to submit response to its draft Remedy Guidelines relevant to proposed mergers and acquisitions. Furthermore, the NMa has invited reactions to its intention not to issue specific NMa guidelines for the assessment of horizontal mergers and acquisitions.
The draft Remedy Guidelines constitute a revision of the Remedy Guidelines published by the NMa in 2002. The revision is considered necessary due to an imminent amendment to the Competition Act. The amendment is currently being reviewed by the Senate of the Dutch Parliament. The NMa has also modified parts of the Remedy Guidelines on the basis of experiences acquired in Dutch and European legal practice. The Remedy Guidelines provide insight into the material and procedural requirements for submitting remedies(see current guidelines issued in 2002, available in Dutch only).
