Prioritization of enforcement investigations by ACM

The Netherlands Authority for Consumers and Markets (ACM) is not able to solve all problems that consumers and businesses face. We therefore have to make choices. When determining which cases we will be dealing with, we ask ourselves the following three questions:

  1. What is the magnitude of the harm to consumers?
  2. What is the public interest?
  3. Are we able to solve the problem effectively?

When we launched ACM, we laid down these three criteria in our strategy document.

By now, we have had three years of first-hand experience of using these prioritization criteria. In this document, we explain why we launch an enforcement investigation in some cases, and not in other ones.
