Draft decision on the code amendment regarding peak supply costs
The Netherlands Authority for Consumers and Markets (ACM) has drawn up a draft decision for the so-called peak supply task of Dutch transmission system operator for natural gas Gasunie Transport Services B.V (GTS). GTS has a statutory task to offer peak supply. To that end, GTS offers services in order to enable license holders to supply natural gas to all end-users with small connections in periods of extreme cold. End-users with small connections are, for example, households and small businesses.
GTS passes the costs for this task on to license holders. Under the Dutch Gas Act, ACM had no power to set GTS’s’ revenues. In addition, the distribution of costs for the peak supply task followed from the Decision on security of supply in the Dutch Gas Act (in Dutch: Besluit leveringszekerheid Gaswet). Said Decision will lapse when the Dutch Energy Act comes into effect. At that time, ACM will be charged with the power to distribute the costs associated with the execution of the peak supply task. With this decision, ACM works out this power in greater detail. It does so by establishing in what way GTS is allowed to pass on the costs associated with the execution of the peak supply task to network users.
