Data Sharing Guidelines (Sharing data from connected products and related services)
Since 12 September 2025, the European Data Act has been applicable. To help businesses comply with this regulation, the Netherlands Authority for Consumers and Markets (ACM) has published guidance.
The Data Act is comprehensive legislation that applies to a wide range of both large and small businesses. In its guidance, ACM explains the rules that manufacturers and providers of smart devices and related services must comply with.
The draft guidance was presented to stakeholders in September 2025. The feedback received has been incorporated into the version now being published. As the European Commission is expected to issue additional guidance later this year, this publication is a preliminary version. It will be updated and finalized later this year.
About the Data Act
This European regulation gives users greater control over the data generated by smart devices and related services. It also makes it easier to switch between cloud service providers and to connect different cloud services.
