ACM introduces the DSA check

- ACM has launched an information tool with which companies are able to check if they need to comply with the Digital Services Act (DSA): the DSA check (in Dutch).

The Netherlands Authority for Consumers and Markets (ACM) has introduced the DSA check: this is an online tool with which owners of websites or apps, for example, are easily able to determine which rules of the Digital Services Act (DSA) apply to them. This DSA check is available on ACM’s website.
Since February 2024, new European rules apply to providers of online intermediaries and platforms. These rules are aimed at creating a safe, reliable, and predictable online environment for both businesses and consumers. The DSA has a tiered system of obligations. This means that additional rules apply to certain companies. In addition, the rules may apply to only some services of a company.
For whom is the DSA check?
The DSA check has been created for websites and apps with “user-generated content,” as well as for online stores and marketplaces. The new DSA rules are comprehensive and new. Both larger and smaller businesses have to comply with the DSA. Smaller businesses usually do not have in-house legal support. The DSA check can help these small businesses determine which rules apply to them.

ACM explains the DSA rules in various manners. For example, ACM published DSA guidelines, hosted a DSA webinar for small to medium-sized enterprises (in Dutch), wrote guidance documents for several target groups (in Dutch), and published information for different target groups on ACM.nl (in Dutch).
On the website of ACM’s consumer information portal ACM ConsuWijzer, consumers can find more information about their rights under the DSA.
