ACM draws up framework to make pilot projects with hydrogen possible

In advance of new legislation, the Netherlands Authority for Consumers and Markets (ACM) wishes to give system operators and energy suppliers opportunities to gain experience already with using hydrogen to heat homes. That is why ACM allows pilot projects with hydrogen in built-up areas if businesses properly ensure the safety of the projects, and if they comply with the consumer protection rules from the Temporary framework for hydrogen pilots (in Dutch: Tijdelijk kader waterstofpilots). This framework offers such opportunities for a period of five years, or until the new legislation is ready.

In 2021, ACM pointed out to the Ministry for Economic Affairs and Climate Policy (EZK) that there was no legislation regarding the supply of hydrogen to consumers. In addition, there is no statutory basis for system operators to take part in experiments with hydrogen. Since it is important, in the context of the energy transition, to gain experience with using hydrogen, ACM has now seen to it that system operators and energy suppliers do not need to wait for new legislation.

Manon Leijten, Member of the Board of ACM, explains: “It is important for the energy transition that businesses and consumers gain experience with using hydrogen. In that context, the starting point is that, for consumers, there is no difference between heating their homes using hydrogen or natural gas. For example, suppliers must ensure that, at all times, sufficient hydrogen gas is supplied, and they must be clear about the costs for consumers. In addition, rates need to be reasonable.”

In the framework, ACM also described the follow-up steps in the event a project is not successful. For example, if the supply of hydrogen can no longer be guaranteed, the system operator must return everything to the pre-pilot situation free of charge.

Safety requirements

In addition to safeguarding consumer interests, it is obviously also important that hydrogen pilots are executed safely. The Ministry of EZK is in the midst of drawing up a policy framework for the safety of hydrogen pilots, and has informed ACM that this framework will be ready before the planned start of the first pilots. In addition, the ministry will charge a regulator with oversight over safety issues in hydrogen pilot projects.
