DTe: Binding Instructions Due to Failure to Provide Data

The Office for Energy Regulation (DTe) has imposed on binding instructions on three electricity producers because they refused to provide data relating to the cost of electricity produced by them. By means of binding instructions, DTe has compelled the companies to provide the data within six weeks.

During the investigation into price peaks on the electricity exchange, Amsterdam Power Exchange (APX), a number of parties challenged DTe's authority to request information. DTe is of the opinion that it is authorised to request information, in accordance with the Electricity Act of 1998, in order to carry out adequate regulation of the electricity market. In DTe's opinion, binding instructions are necessary to guarantee the provision of information.
