OPTA makes it mandatory for A2000 to transmit Canal+ digital programmes

The cable operator, Kabeltelevisie Amsterdam (also known as A2000) is required to present an offer to Canal+ for the transmission of the latter’s programmes in digital form as of 15 September 1999. In addition, A2000 must assist with an audit to determine the tariff it may charge for transmitting Canal+ programmes.

OPTA has decided this in response to a dispute between the programme provider, Canal+, and the cable operator, A2000. Since the introduction of the Telecommunications Act on 15 December 1998, OPTA has had the power to hand down rulings in disputes involving providers of radio or television programmes and cable operators. The dispute between Canal+ and A2000 was the first dispute involving access to cable networks.

At present A2000 is transmitting Canal+ programmes through two channels in analogue form within its area of coverage (Amsterdam and surroundings). Digital transmission would allow Canal+ to make do with one channel. A2000 has one month within which to present Canal+ with a breakdown of the costs involved in the provision of the additional facilities which would be required to enable digital transmission. If the two parties are unable to reach agreement in this respect, OPTA will take an additional decision if necessary.

Canal+ had also asked OPTA to rule on the level of the tariffs which A2000 is allowed to charge for transmitting a programme. However, OPTA first wishes to inspect A2000’s accounts before it takes a decision in this respect. A2000 is required to assist with this audit. It is not yet known when OPTA will take a final decision in relation to this matter.
