NMa Dismisses Complaint by FHRS against CR Delta
The cattle improvement organisation CR Delta has not abused its dominant position by providing data from its database of data relating to cattle (NIS) nor in the tariffs which CR Delta charges for issuing pedigree certificates. NMa has ascertained this following an investigation. The reason for the investigation was a complaint by Fries Hollands Rundvee Stamboek (FHRS) with regard to the refusal by CR Delta to provide FHRS with data from the NIS database in a way which made it possible for FHRS to process this immediately and electronically into pedigree certificates. In addition, FHRS complained about the fact that CR Delta apparently charged tariffs for pedigree certificates which were too low, with the aim of driving FHRS from the market.
After carrying out an investigation, NMa has established that FHRS refused to pay a commercial tariff for extracting data from the database. In NMa's opinion, this justifies CR Delta's refusal to provide FHRS with the electronic access it desired. It also appears that the tariffs which CR Delta charges for pedigree certificates are not unfairly low.
